Energy and renewables in the Dominican Republic

A practical framework for assessing renewable-energy projects: incentives, CNE concessions, ETED connections, PPAs, approvals, transaction structures and key risks.

Dominican renewable-energy projects combine infrastructure development, regulated electricity-market participation and long-term operating exposure. A strong solar or wind resource is only a starting point. Land control, a usable grid connection, lawful development rights and credible energy sales must fit together before a proposal becomes financeable. This guide offers a screening framework, not investment, legal or tax advice.

At a glance

Indicator

Value

Year

Source

Electricity injected into SENI

23,068.6 GWh

2024

MEM, electricity performance, 2024

Total nominal installed capacity

5,950 MW

2024

MEM, annual generation bulletin, 2024

Eligible import-tax exemption

100%

2024

CNE, import exemption guide, 2024

Market and generation mix

The Ministry of Energy and Mines reports 23,068.6 GWh injected into the interconnected national system, SENI, during 2024. This is system electricity, not renewable output and not a measure of available capacity. MEM, electricity performance, 2024 Investors should distinguish annual energy delivered from installed megawatts, dependable capacity and the power actually available at a particular hour.

The MEM annual bulletin for 2024 identifies natural gas, coal, fuel oil, hydro, solar, wind and biomass in the system capacity matrix. Its installed-capacity presentation must not be described as generation shares. MEM, annual generation bulletin, 2024 Thermal and renewable technologies coexist, so renewable economics depend on dispatch, system flexibility and the location and timing of production, not simply the national resource map.

Screen each opportunity against its commercial function: a utility-scale generator selling into the interconnected system, supply to an eligible industrial customer, or on-site generation serving a business load. The applicable permissions and economics differ. A hotel rooftop installation is not a smaller version of every utility-scale concession, and a storage proposal needs its own revenue and operating analysis.

Legal framework and incentives

Law 57-07 of 2007 provides the renewable-energy incentive framework, alongside the broader electricity regime. Read the enacted law with subsequent amendments and implementing requirements. The original text alone is not sufficient evidence that every historical tax benefit remains available to a new investment. Law 57-07, 2007 Obtain a written, project-specific assessment from Dominican energy and tax counsel.

CNE’s 2024 import guide describes a 100% exemption from import taxes for qualifying renewable-system equipment listed under the law. This is an equipment-specific benefit, not a blanket exemption for all project purchases or profits. Applications and implementation involve CNE and the relevant tax and customs authorities. CNE, import exemption guide, 2024 Confirm the approved equipment schedule, importer, shipment timing and supporting invoices before placing orders.

The CNE service guide issued in 2024 separately lists import relief, local-purchase ITBIS relief, tax-credit authorization and external-financing tax procedures. These are separate administrative tracks, not interchangeable approvals. CNE, service guide, 2024 Do not assume an incentive transfers automatically when the project company, equipment design or funding structure changes. Model the project without unconfirmed relief and record any later approval as a documented change.

How transactions are structured

A transaction may use a Dominican special-purpose company holding the development rights and contracts. Investors can negotiate equity participation, shareholder funding or project debt depending on their position and risk appetite. These are structuring alternatives, not evidence that a particular project qualifies for nonrecourse lending. Identify the owner of every concession, lease, permit and technical study.

The contractual package should connect land access, engineering and construction, equipment supply, operations and maintenance, insurance, energy sales and financing. Prepare a responsibility matrix showing which counterparty carries each interface risk. Where a landowner contributes a site, independently verify ownership, valuation and enforceable access rather than accepting an equity allocation as proof of good title.

Shareholder documents should address reserved decisions, further capital calls, dilution, related-party contracts, reporting, distributions and exit rights. Development funding can be released against evidenced milestones rather than broad statements of progress. Align lender security and potential step-in rights with consent requirements under the project contracts, concessions and applicable law.

PPAs and commercial diligence

A power purchase agreement, or PPA, allocates price and delivery obligations but does not remove development risk. Confirm the buyer’s legal eligibility, procurement requirements and credit position. Review currency, indexation, invoicing, payment security, termination compensation and dispute resolution. A signed commercial term sheet is not equivalent to an effective, enforceable and fully approved energy-sale contract.

Production forecasts should distinguish resource uncertainty, equipment losses, degradation, electrical losses and potential curtailment. Determine who pays when electricity cannot be delivered because of a transmission outage, plant failure or dispatch instruction. Where contracted output exceeds actual output, examine replacement-power obligations. Do not treat all forecast generation as billable electricity merely because an attractive tariff is quoted.

Merchant exposure and storage revenue assumptions deserve separate scrutiny. Test hourly production against realistic settlement arrangements and buyer demand. Storage requires a clear operating strategy, degradation allowance, replacement budget and permitted charging and discharge arrangement. The financial model should explain the legal and contractual basis for every revenue line instead of assuming that international market practices automatically apply locally.

Permits, concessions and grid approvals

CNE’s 2024 guide distinguishes provisional concessions, definitive concessions and renewable-resource study authorizations. A provisional development position should not be marketed as an operating authorization. CNE, service guide, 2024 Ask counsel to map the required route for the technology and business model, including the relevant executive and regulatory actions, registration conditions and continuing obligations.

ETED describes its no-objection certification as authorization for interconnection at the requested point and capacity, with a validity period. Its service includes electrical studies and requires project and interconnection information. ETED, interconnection no-objection service, undated This is not proof that all transmission works are built, funded or commissioned. Verify study assumptions, reinforcement costs, rights of way, expiry conditions and the route to final energization.

Environmental authorization is a separate workstream. The Environment Ministry’s 2022 guidance includes project identification, corporate documentation and evidence connecting the sponsor to the land. Environment Ministry, environmental authorizations, 2022 Assess biodiversity, water, drainage, community impacts and access corridors early. Build a coordinated approval register covering construction permissions where applicable, grid engineering, metering, protection tests and operating requirements. Filing an application is not permission to start unrestricted works.

Key risks and downside analysis

Grid congestion can change the usable value of a site even when its solar or wind resource is excellent. Ask an independent engineer to test connection feasibility and review dispatch-related assumptions. Examine what happens if network upgrades arrive after the plant is ready. Contractual completion dates should leave room for interfaces outside the equipment supplier’s direct control.

Land defects, community opposition, hurricane exposure, flooding, corrosion and equipment underperformance can impair construction and operations. Obtain site-specific technical and insurance advice. Confirm deductibles, exclusions, business-interruption conditions and reinstatement obligations. A policy schedule without a review of covered perils and claims conditions is not sufficient evidence of protection.

Counterparty nonpayment, foreign-exchange mismatch, refinancing requirements and unapproved tax assumptions can undermine otherwise plausible forecasts. Stress-test delays, lower delivered energy, higher construction costs and weaker collections together. Review environmental compliance and concession deadlines throughout the holding period. No national energy target, tax incentive or signed PPA guarantees a return or an exit.

Practical next steps

Begin with a concise screening pack: sponsor and beneficial ownership, technology, site control, development status, connection evidence, energy-sale strategy, funding request and use of proceeds. Separate issued approvals from applications and draft documents. Commission independent legal, technical and tax diligence before negotiating final investment commitments or relying on a construction schedule.

Create a conditions-precedent checklist and a model that ties each critical assumption to documentary evidence. Define who pays development overruns, how information is shared and what happens if a concession or grid milestone is not achieved. Preserve a clear record of outstanding matters rather than presenting all unresolved items as routine administrative work.

Sponsors can list a project on Dominican Investing with an accurate description of its stage and evidence available for review. Prospective participants can register as an investor and describe their mandate. An introduction is not regulatory approval, due diligence or a recommendation to invest. Seek independent professional advice and assess the possibility of losing capital.

Sources

MEM, electricity performance, 2024

MEM, annual generation bulletin, 2024

Law 57-07, 2007

CNE, service guide, 2024

CNE, import exemption guide, 2024

ETED, interconnection no-objection service, undated

Environment Ministry, environmental authorizations, 2022
